Terms and conditions
Draft. Not finished legal text.
Everything in [square brackets] is still missing. The operator's name, address and contact details have to be filled in, and the wording should be checked by a lawyer or a legal-text service before the shop goes live.
1. Scope
These terms apply to all orders placed in the online shop Dewly at dewlycare.com with [Full name of the owner, or company name with legal form], [Street and number], [Postcode] [City], Germany ("we", "us").
Our shop is for consumers. A consumer is any natural person who enters into a contract for purposes that are mainly outside their trade, business or profession (§ 13 BGB).
2. Products
We sell cosmetics and beauty products. Each product page shows the product's main features, its full list of ingredients (INCI), its net content, directions and warnings where the maker gives them, and the manufacturer and the responsible person in the EU.
Shades and colours can look slightly different on a screen than in reality.
3. How the contract is made
The products shown in the shop are not a binding offer by us, but an invitation to order.
You place products in the cart and go to checkout. You are then taken to a secure payment page run by Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin 2, Ireland, where you enter your e-mail address, delivery address and payment details. Before you pay, you can check all your details and the order summary and correct them, or go back to the cart.
By pressing the pay button on that page you place a binding order. The contract is concluded when your payment is confirmed. You then receive a confirmation of your order and a receipt by e-mail.
The contract languages are English and German. We do not store the contract text for you in a customer account (there are no accounts); the details of your order are in the confirmation e-mail, and these terms can be read, saved and printed on this page at any time.
4. Prices and shipping costs
All prices are final prices in euros. [Owner to decide: regular VAT ("incl. statutory VAT") or the small-business rule (§ 19 UStG, no VAT shown)]
Shipping costs €9.99 per order, and is free for orders with an item total of €79.00 or more (measured before any bundle discount).
We deliver only within the European Union, to these 27 countries: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czechia, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden.
5. Payment
You pay on Stripe's secure payment page by card (credit or debit card), Apple Pay or Google Pay. Apple Pay and Google Pay only appear on devices that support them. The amount is due when you order and is charged when the payment is confirmed.
6. Delivery
We send your order to the delivery address you gave. Delivery time: [e.g. 2–5 working days within Germany, 4–8 within the EU], counted from the day after your payment is confirmed.
If a product you ordered is not available after all, we tell you straight away and refund what you paid for it without delay.
7. The 3-item offer
If one order contains at least 3 items, you get 10% off the price of all items in that order, and we add a small gift. Items are counted by quantity: 3 of the same product count just like 3 different ones. The discount does not apply to shipping. We choose the gift; it is free, and there is no choice of item and no cash alternative.
If you withdraw from part of such an order and fewer than 3 items remain, the items you keep no longer qualify for the discount. We then refund what you paid for the returned items minus the discount that was granted on the items you keep. You may keep the gift.
8. Retention of title
The goods remain our property until they have been paid for in full.
9. Right of withdrawal
As a consumer you have a statutory right of withdrawal. The details, the exception for opened hygiene-sealed cosmetics and a model form are on the page Returns and withdrawal.
10. Warranty and liability
The statutory rights for defects apply (gesetzliche Mängelhaftung).
If a parcel arrives visibly damaged, please tell the delivery driver if you can and let us know. This helps us claim against the carrier; your statutory rights do not depend on it.
We are liable in accordance with the statutory provisions.
11. Customer service and disputes
Questions, complaints and returns: please e-mail [hello@dewlycare.com].
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
12. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer living in another EU country, this choice of law does not take away the protection of the mandatory consumer law of your country.
If any provision of these terms is invalid, the rest of the contract remains valid.
